Beyond Polish - Terms and Conditions Agreement

This program is for Beyond Polish US.  

Programs may be subject to change every quarter. 

Eligibility

As a Brand Ambassador, I understand and agree to the following:

By signing up for the Beyond Polish Brand Ambassador program, I agree to the terms and conditions listed below:

A. As a Brand Ambassador, I understand and agree to the following:

By signing up for the Beyond Polish Brand Ambassador program, I agree to the terms and conditions listed below:

1. I am 18 years of age or older.

2. I understand that the program is only valid for orders placed for shipment within the U.S. on http://beyondpolish.com.

3. To remain in the program - I must do the following:

4. Generate 1 sale a month with an order value at least $50

5. Generate clicks on my affiliate link

6. Be active on my social platform or website

7. When promoting Beyond Polish products - I will tag @beyondpolish & using the hashtags: #polishwithbeyond #beyondpolish. 

8. I MUST post and tag all products that Beyond Polish sends to me as collaborations and comply with those terms agreed between myself and Beyond Polish. 

9. I WILL NOT share my codes to coupon and deal sites. Beyond Polish will check these sites frequently and any commissions will be revoked if found on these sites.

10. I will not run paid ads to Beyond Polish sites. 

11. I understand that I will not receive additional compensation for use of images or videos used on the company’s social media networks. 

12. If orders are submitted without using my affiliate code or link, these orders will not be credited to my account. No cash compensation will be provided by the company. Only one promotion code can be applied per order.

13. I will not share my personal code with anyone else. No personal code usage will earn myself any commission.

14. I will not share my affiliate code/link on any Beyond Polish social media platform or website.

15. I will not sell company products on unauthorized websites on the internet or in retail establishments.

16.  I will protect the company’s trademark by not reproducing the company’s name/trademark or any company materials for use in advertising without the written approval of the company.

17.  I will promote Beyond Polish products on social media accounts by posting appropriate photos showcasing the products. I will contact the company if a clear understanding of “appropriate” photos is needed. I will not receive any financial or other compensation for product promotion through my social media network.

18.  I will conduct myself in a manner that reflects the highest standard of integrity and responsibility in keeping with the reputation of the company. If I do not uphold these standards, I will be immediately removed from the Brand Ambassador Program and forfeit any unused gift cards and all promotional codes effective immediately.

19.  If I choose to leave the Brand Ambassador program, I must use any unused gift card balance within 14 days of leaving the program. Any photos sent to Beyond Polish will remain in their database to use on their social media platforms and marketing campaigns.

20. I agree that any discount codes given may have restrictions on products.  Commissions may also be restricted from certain products such as gift cards or special collections.  

21. I agree that the company reserves the right to cancel this agreement at any time.

22. I agree to the company’s privacy policy and I have read and agree to these terms

23. I agree that the company will have the right to update the program structure and commission as needed at any time. 

24. Unless terms are agreed upon with Beyond Polish prior to joining, for all content that I tag Beyond Polish & for any content using Beyond Polish items, I grant Beyond Polish the royalty-free right and license to publish, copy, re-post, link to or otherwise use my Posts, my Social Platform handle, my name, and my image and likeness as depicted in a Post, in whole or in part, for any purposes in our discretion, in any and all mediums, without additional compensation, notice, review or approval.

B. Beyond Polish. (Company) understands and agrees:

1. The Company agrees to make payment to Brand Ambassadors 7 business days after the end of the month. 

2. The Company will retain the rights to use any photos they send us or tag us in, even if the Brand Ambassador exits the program.

3. The Company agrees to adhere to the Company’s privacy policy these terms and conditions.

C. General:

1. This agreement is subject to acceptance by the company and is conditioned by the acceptance of these terms and conditions.

2. Either party may terminate this agreement immediately for cause or without reason upon written notice.

3. Beyond Polish may discontinue the Brand Ambassador Program at any time.

4. The Brand Ambassadors will not be treated as a company employee for any reason.

D. Commission 

Beyond Polish Brand Ambassadors earn commission for all referrals who shop using their link or pre-defined code. Commissions are based off of the tier being offered to you.  Certain products may not be eligible for commissions, such as gift cards. Coupons given are only valid towards regular priced items.  Commissions are paid out via PayPal, within 7 business days after the end of the month.   Commissions are calculated off the purchase price, before taxes & shipping and after applied discounts.  It is your responsibility to ensure your PayPal account details are accurate and up-to-date in order to receive payment. We reserve the right to reverse commissions due to returns, order cancellations and erroneous order duplications. We also reserve the right to defer or refuse commissions for disputed orders or orders we reject and cannot fulfill.

Notwithstanding the foregoing, Qualifying Purchases are disqualified and no Commission shall be due whenever (a) they occur in connection with a violation of this Agreement, or any other terms, conditions, specifications, statements, and policies that we may issue from time to time that apply to the Program; (b) any purchases that occur after termination of your Agreement; (c) any order where a cancellation, return, or refund has been initiated; (d) any purchase by a customer who is referred to the Beyond Polish Sites through any advertisement that you purchased through participation in bidding or auctions on keywords, search terms, or other identifiers that include the word “Beyond Polish” or any other Beyond Polish trademark (or variations or misspellings of any of those words, (e) any purchase by a customer who is referred to the Beyond Polish Sites by a link that is generated or displayed on a search engine (including Google, Yahoo, Bing, or any other search portal, sponsored advertising service, or other search or referral service, or any site that participates in such search engine’s network); (f) any purchase by a customer who is referred to the Beyond Polish Sites by a link that sends users indirectly to the Beyond Polish Sites via an intermediate site, without requiring the customer to click on a link or take some other affirmative action on that intermediate site; (f) any purchase by a customer, where such customer does not comply with the terms and conditions applicable to the Beyond Polish Sites; or (g) any purchase that is not correctly tracked or reported because the Your Code is not properly formatted or inserted in the Beyond Polish Sites’s checkout process.

E. Legal Compliance

All affiliates must comply with all federal, state and local regulations within your jurisdiction. This includes applicable governing marketing emails (ie CAN-SPAM Act), and all other anti-spam laws. Refersion reserves the right to suspend or remove affiliates from our affiliate program at any time, without warning. Upon termination you agree to discontinue use of all links, logos, banners and promotional materials provided to you by Beyond Polish. Affiliates terminated due to malicious publishing tactics will also have commissions revoked and face possible omission from the Beyond Polish Ambassador Program.
